I. Introduction

These Terms and Conditions set out the rules for making purchases in the Online Store operated at www.outfit.pl.

The Online Store conducts retail sales via the Internet.

All goods offered in the Online Store are brand new, originally packaged, free from physical and legal defects, and have been legally introduced into the Polish market.

The owner of the online store www.outfit.pl, is OUTFIT World Fashion 1 Sp. z o.o., subject to entry in the National Court Register under the number 0000971284, NIP 536-196-25-79, REGON 522002360.

II. Placing orders

To place an order, you must read and accept the Terms and Conditions.

All prices for goods given on the website of the Online Store are gross prices given in Polish zloty. The cost of return shipment is covered by the Seller, provided that the form of such shipment is agreed with the Seller in advance.

The order is placed via the website www.outfit.pl

An order is considered to be placed if the Buyer fills in the order form, provides contact details such as: name, surname, email address, phone no., delivery address and places the order by selecting the "I confirm the purchase (confirmation of purchase with obligation to pay)" button.

At the time of placing the order, the buyer explicitly confirms that he knows that the order entails an obligation to pay, of which he is informed through the "I confirm purchase" button.

III. Method and date of payment

Payment for the ordered goods can be made, depending on the form of payment chosen by the Customer:

(a) cash on delivery (upon receipt of goods),

b) via electronic payment system (name of the system) (immediately after placing the order),

c) by bank transfer to the bank account of the Online Store (within 7 days of placing the order):

Title: order number and/or name of the ordering person

After placing an order in the Online Store www.outfit.pl , depending on the form of payment selected by the Buyer:

(a) in the case of selection of the cash on delivery option, the Seller will confirm by phone or e-mail (to the Buyer's e-mail address) receipt of the order.

b) in the case of choosing the option of shipment via electronic payment system, the Seller, upon receipt of payment, will confirm by phone or e-mail (to the Buyer's e-mail address) receipt of the order.

(c) if the transfer option is selected, the payment should be made to the Seller's account number given above within 7 days from the date of placing the order. The amount of the payment should be equivalent to the value of the purchased goods. The order is automatically canceled if the amount for the ordered product is not received in the Seller's bank account within 7 days from the date of the order. Upon receipt of payment, the Seller will confirm by phone or e-mail (to the Buyer's e-mail address) receipt of the order.

The Seller will issue a receipt or a VAT invoice for each product sold. Willingness to receive a VAT invoice for the purchased goods should be notified at the time of placing the order, along with full details for the invoice (including VAT number). The VAT invoice may be attached to the shipment or sent to the indicated e-mail address of the Buyer in the form of an electronic image of billing documents, depending on the option selected by the Buyer.

IV. Fast order processing

The Seller reserves the right to contact the Buyer before processing the order.

Goods are shipped to the address indicated in the order. The Seller will inform the Buyer of an incorrectly filled order form that prevents or may delay shipment.

Goods are shipped through courier companies or through the Polish Post Office - depending on the form chosen by the Buyer.

The shipment is delivered according to the date specified when placing the order. This is an approximate delivery time and applies to orders with the "cash on delivery" payment option. When choosing the payment option "transfer" or "payment via electronic payment system" to the time given on the website should be added the time of crediting the funds to the Seller's bank account (1-2 working days).

All orders with "cash on delivery" payment option, placed on business days until 3:00 pm, are shipped the same day! Placed on working days after 15:00 or on holidays, we deliver on the next working day.

In the case of an order with the payment option "bank transfer" or "payment via electronic payment system", we ship the goods after the payment is credited to the Seller's account, on the day the payment is credited - if the crediting takes place on a working day until 3:00 pm, on the next working day - if the crediting takes place on a working day after 3:00 pm or on a non-working day.

The buyer will be informed about the extension of the order processing time for any reason in advance, by email or telephone.

Shipping is carried out on business days. This means that goods for which payment is credited on Friday with the payment option "bank transfer" or "payment via electronic payment system", or that goods with the payment option "cash on delivery", for which the order was placed on Friday, will be shipped no later than Monday of the following week, unless Monday is a public holiday.

At the time of shipment of the goods, an order confirmation email will be sent to the address provided by the Buyer during registration. If the Buyer does not receive the shipment confirmation within 24 hours from the assumed date of payment posting (usually one or two business days ) or placing an order on delivery, please contact us - this will speed up the shipping procedure in case of any problems with the payment or purchase information.

If the ordered shipment has not reached the Buyer within the maximum time specified in accordance with the rules indicated above, please contact us - this will be the basis for the initiation of the complaint procedure on our part.

V. Right of withdrawal from the contract

The buyer has the right to withdraw from this contract within 14 days without giving any reason.

Goods must be returned in unaltered condition: unused, with a set of attached tags, with red security attached.

The term of withdrawal expires after 14 days from the day on which the Buyer took possession of the goods or on which a third party other than the carrier and indicated by the Buyer took possession of the goods.

To exercise the right of withdrawal, the Buyer must inform the Seller of his decision to withdraw from this contract by a unilateral statement by e-mail.

In order to comply with the deadline for withdrawal, it is sufficient for the Buyer to send information regarding the exercise of his right of withdrawal before the expiration of the deadline for withdrawal.

VI. Effects of withdrawal from the contract

In the event of withdrawal from this contract, we shall return to the Customer all payments received from the Customer, including the costs of delivery of the goods (except for additional costs resulting from the delivery method chosen by the Customer other than the cheapest ordinary delivery method offered by us), immediately and in any case no later than 14 days.

Please send back or hand over the goods to us immediately, and in any case no later than 14 days from the day on which the Buyer informed us of the withdrawal from this contract. The deadline is met if the Buyer sends back the goods before the expiration of the 14-day period from the date of informing the Seller.

The buyer shall be liable for any diminution in the value of the goods resulting from using them in a manner other than necessary to ascertain the nature, characteristics and functioning of the goods.

No withdrawal from the contract:

The right of withdrawal does not apply to the Buyer (Consumer) with respect to contracts in which the subject of performance is a delivered thing, which after use cannot be returned due to traces of use or for hygienic reasons.

VII. Complaint procedure

The Seller shall provide a warranty for the goods sold for a period of 24 months from the date of purchase. If the goods have defects, regardless of claims under the warranty, the Seller shall also be liable to the Buyer under the warranty. Complained goods should be securely packed and sent back with the complaint notification:

Please attach the proof of purchase to the package.

The maximum time for processing a complaint is 14 days from the date of complaint.

VIII. Privacy Policy

The administrator of the databases of personal data provided by Buyers of the Online Store in connection with purchases is the Seller.

By placing an order, the Buyer agrees to the processing and use of the personal data provided for the purpose of executing sales contracts. The data are provided voluntarily.

The Buyer has the right to access the content of his data and to control the processing of the data concerning him, and in particular the right to: demand completion, updating, rectification of personal data, temporary or permanent suspension of their processing or their deletion, if they are incomplete, outdated, untrue or have been collected in violation of the law or are no longer necessary for the purpose for which they were collected.

Personal data placed in the database of the www.outfit.com.pl store are processed exclusively for the purpose of executing sales contracts. Accordingly, they may be made available to entities responsible for the delivery of purchased goods to the Buyer.

This data is collected with due diligence and properly protected from access by unauthorized persons, in accordance with the Act of August 29, 1997 on the Protection of Personal Data (Journal of Laws of 1997 No. 133 item 883).

IX. Settlement of disputes

Any disputes arising from the application of these Regulations and/or in connection with the conclusion of contracts between the Store and the Buyer will be considered by the court of competent jurisdiction in accordance with the provisions of the Civil Procedure Code.

A Buyer who is a consumer has, among other things, the following possibilities of using out-of-court complaint handling and claim investigation:

(a) The Buyer is entitled to apply to a permanent amicable consumer court operating at the Trade Inspection with a request to resolve a dispute arising from the concluded Sales Agreement.

b) The Buyer is entitled to apply to the provincial inspector of the Commercial Inspection with a request to initiate mediation proceedings for the amicable settlement of a dispute between the Buyer and the Seller.

c) The Buyer may obtain free assistance in resolving a dispute between the Buyer and the Seller, also using the free assistance of a district (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection (such as the Federation of Consumers, Association of Polish Consumers). Advice is provided by the Consumer Federation at the toll-free consumer hotline number 800 007 707 and by the Association of Polish Consumers at email address: porady@dlakonsumentow.pl.

(d) Pursuant to Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC (Regulation on ODR in consumer disputes), the Seller as a trader established in the Union entering into online sales or service contracts provides an electronic link to the ODR (Online Dispute Resolution) platform for out-of-court dispute resolution: europa.eu/consumers/odr/.
